論逮捕后的羈押期限
摘 要
國際通行的“逮捕”，是指限制個人的自由并將其帶到執(zhí)法部門的行為，逮捕后是否關(guān)押必須由法官或具體有法律授權(quán)的官員另行決定。
刑事訴訟作為1種程序，其部分內(nèi)容就是規(guī)定訴訟主體行使權(quán)利義務(wù)的期限的。而期限又是由期間來度量的。羈押是限制犯罪嫌疑人和被告人人身自由，保證偵查和審判順利進(jìn)行的重要手段。同時羈押也是最嚴(yán)厲的1種強(qiáng)制措施，它不僅完全剝奪了被羈押人的人身自由，把被羈押人完全置于偵查和審判機(jī)關(guān)的直接控制下。而且，逮捕后羈押的期間在所有強(qiáng)制措施中是最長的。因此，在刑事訴訟中對犯罪嫌疑人、被告人正確及時地適用羈押，可以有效地防止其逃跑、自殺、毀滅罪證或繼續(xù)犯罪；而濫施羈押，則會嚴(yán)重侵犯公民的基本權(quán)利，違背法律的根本宗旨。
